RMV Risk of Recidivism Assessment

What is an Immediate Threat License Suspension?

An RMV Immediate Threat suspension occurs when the Massachusetts Registry of Motor Vehicles receives information indicating that a person’s continued driving may pose an immediate danger to public safety. The RMV may suspend the person’s license immediately—often before the underlying court case is resolved—and require a hearing, supporting documentation, and other conditions before reinstatement.

What Is an RMV Risk of Recidivism Assessment?

A Massachusetts RMV Risk of Recidivism Assessment is a specialized substance use evaluation that may be required following a license suspension or revocation involving alcohol, drugs, or certain medications.

The evaluation reviews your substance use history, current circumstances, treatment or recovery history, and factors that may increase or reduce the likelihood of future substance-related problems. A written report summarizes the clinical findings, risk of recidivism, and any recommendations.

I provide virtual RMV substance use evaluations and risk of recidivism assessments throughout Massachusetts, including evaluations related to Immediate Threat suspensions and license reinstatement.

The Massachusetts RMV License Reinstatement Process

Requirements vary depending on the reason for your suspension and circumstances. When substance use is involved, the RMV may ask you to provide clinical documentation before considering reinstatement.

The process may include:

  • Review your RMV hearing requirements to determine what documentation or evaluations are needed.

  • Complete a substance use evaluation and Risk of Recidivism Assessment when requested by the RMV.

  • Provide relevant records to the evaluating clinician, including RMV documentation and available treatment or recovery records.

  • Complete any additional medical or mental health evaluations required by the RMV.

  • Receive your written evaluation report documenting the clinical findings, risk of recidivism, and recommendations.

  • Submit the required documentation to the RMV for consideration as part of the license reinstatement process.

Because requirements differ by case, completing an evaluation does not guarantee license reinstatement. Your RMV hearing documentation should identify the specific requirements that apply to you.
